Canada extends the ability to obtain work permits more easily

The measures apply to those who are in Canada as a visitor.

In August 2020, Canada allowed aliens with visitor status who have an offer from a Canadian employer to obtain a work permit without leaving the country. Such measures were initially in force from August 24, 2020 to March 31, 2021.

Previously, foreign nationals who wanted to work in Canada had to apply for a work permit before entering the country. If they were already in Canada, they had to leave and re-cross the border.

Yesterday, March 29, the Immigration, Refugee and Citizenship Canada (IRCC) extended the simplified permit regime until August 31, 2021. Any visitor to Canada with a job offer can apply for a work permit without leaving the country. The date on which they arrive in Canada does not affect anything.

To apply, you must meet the following requirements:

  • be legally present in Canada at the time of application;
  • to remain in Canada with the same status;
  • apply no later than August 31, 2021 to obtain a work permit from a specific employer;
  • The employer must complete a labor market impact assessment (LMIA) if required.

Temporary measures also allow people who have had a valid work permit in the last 12 months to start working for a new employer before they get a new permit.
