The "Immigrant.Today" project (referred to as "Site", "We", "Administration", "Project") includes:

These Terms of Use (hereinafter referred to as Terms) govern the relationship between the "Immigrant.Today" Project and the Site User (hereinafter referred to as "User"). A User is a person registered on the Site, as well as anyone who has visited the Site pages at least once without registration.

1. General Conditions

1.1. By using the Site, software, and other files as a User, you agree to comply with all conditions outlined in these Terms of Use (hereinafter referred to as "Terms"), including by registering your account on the Site. These Terms constitute a legally binding agreement between the User and the Administration, the subject of which is providing the user with services to use the Site and its features.

1.2. We may change these Terms at any time, and such changes take effect immediately upon publication on the Site. The Administration is not obligated to notify Users of changes to the Terms.

1.3. You must read these Terms before using the Site. If you continue to use the Site after the publication of amended Terms, it means you agree to comply with the Terms and all their changes.

1.4. If any conditions of these Terms or changes to them are unacceptable to you, you may choose not to use the Site or terminate your account as specified in clause 4.5 of the Terms.

1.5. The Administration reserves the right to deny access to the Site to any User without explanation.

1.6. Using the Site or any of its services automatically implies full and unconditional acceptance of these Terms by the User, including all current and future changes. If a User disagrees with any point of these Terms, they must immediately stop using the Site.

2. Site Content

2.1. Materials published on the Site are intended for personal, non-commercial use. All materials published on the Site, including but not limited to: news, photos, images, illustrations, audio and video clips, texts, logos, trademarks, databases, software (hereinafter referred to as "materials" or "content") are protected by copyright and are owned or controlled by the Administration or the content provider. You must comply with all additional copyright notices, information, or restrictions contained on any page.

2.2. The Site's content is protected by copyright in accordance with Canadian law and international copyright law. You may not modify, publish, transmit, participate in the transfer or sale, reproduce (except as provided in clause 2.3 of these Terms), create new works, distribute, perform, or in any way use the site's content (including software) in whole or in part.

2.3. You may download or copy the Site's content, other components, and elements displayed on the Site only for personal use, provided you comply with all copyright and other notices contained therein. Copying or storing any content for purposes other than personal use is strictly prohibited without prior written consent from the Administration.

2.4. Online publications and mobile applications are allowed to use information posted on the Site for free, provided they include an open hyperlink and mention the original source no lower than the first paragraph. The Administration reserves the right to revoke this permission for any publication at any time without explanation.

2.5. Any unauthorized use of the content may violate copyright laws, trademark laws, privacy and publicity laws, and communication regulations.

3. Disclaimer

3.1. We make reasonable efforts to ensure the quality of information available on the Site. The information contained on the Site is provided for general informational purposes only and does not in any way assess a person's right to immigrate to any country.

3.2. The information contained on this Site should not be considered legal services or legal advice. Users should contact a qualified immigration lawyer or licensed immigration consultant and obtain appropriate professional advice relevant to their specific circumstances before taking any actions or decisions based on any materials presented on the Site.

3.3. Materials posted on the Site may contain technical, typographical, or photographic errors. We may make changes to the materials contained on the Site at any time without prior notice.

3.4. We are not liable for any direct, indirect, incidental, special, or punitive damages or losses incurred as a result of:

  • using or inability to use the Site;
  • using information contained on the Site;
  • making decisions based on information posted on the Site;
  • any delays or failures in the Site's operation;
  • viruses or other malicious software obtained through the Site;
  • unauthorized access to data transmissions;
  • statements or behavior of any third party on the Site.

3.5. We are not responsible for any information posted on third-party websites that the User accesses through the Site, including, but not limited to, any opinions or statements expressed on third-party sites or in their content.

3.6. The Administration does not guarantee that:

  • The website will meet your requirements;
  • The website will be available continuously, on time, securely, or without errors;
  • The results that may be obtained from using the website will be accurate or reliable;
  • The quality of any products, services, information, or other materials purchased or obtained by you through the website will meet your expectations.

4. Registration and Security

4.1. As part of the registration or account creation process, you will create login credentials by choosing a password and providing an email address. You agree to provide accurate, current, and complete information during registration and to keep it up to date.

4.2. Each registration is valid for one user only. You must not share your login credentials to allow any other person access to your account. We may cancel or suspend your access to the website if you share your login credentials. You are responsible for keeping your password confidential. Failure to comply with the above is considered a violation of the Terms, which may result in the immediate termination of your account.

4.3. We welcome participation from people of all ages on the website; however, to protect children, individuals under the age of majority cannot register on the website.

4.4. You are responsible for any use or activity on your account on the website, including use of the account by third parties with your permission.

4.5. You can terminate your account at any time by contacting mail@immigrant.today.

The administration reserves the right to remove or deactivate your account, delete any content or information you have posted on the website, or prohibit the use of all or any part of the website for any reason or without reason, without prior notice and without liability to you or any other party.

5. Services and Payments

5.1. The administration reserves the right to:

  • modify the website at its discretion;
  • edit or delete materials published on the website;
  • provide paid and free services to Users (hereinafter referred to as "Services");
  • change the cost and types of Services, their duration;
  • make changes to the Terms unilaterally;
  • process User's personal data;
  • suspend or terminate the provision of any services without prior notice;
  • refuse to provide services to any User without explanation.

5.2. Refunds for paid services, including business promotion packages in the business directory, are not possible.

5.3. When subscribing to the website's services, funds are automatically charged within the period chosen by the user. Automatic renewal can be disabled in the business owner's personal account. The administration is not responsible for any problems with automatic debiting of funds that occurred due to the fault of payment systems or banks.

5.4. In case of a refund for other services, a fixed refund fee of $100 CAD is withheld. The administration reserves the right to change the refund fee without prior notice.

5.5. Payments are accepted in various currencies, including Canadian dollars (CAD) and US dollars (USD). The administration reserves the right to determine and change the list of accepted currencies. The user is solely responsible for all fees associated with currency conversion and bank transfers.

6. Prohibited Actions

6.1. When using the website, it is prohibited to:

  • violate any applicable laws or regulations;
  • impersonate another person or organization;
  • upload, post, or transmit any content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable;
  • upload, post, or transmit any materials containing viruses or other harmful components;
  • take actions that may disrupt the normal operation of the website;
  • collect or store personal data of other users without their explicit consent;
  • use automated scripts to collect information or interact with the website;
  • gain unauthorized access to the website's systems or networks;
  • attempt to probe, scan, or test the vulnerability of the website's security system;
  • interfere with or disrupt services, servers, or networks connected to the website;
  • use the website to distribute advertising or other unwanted commercial content without prior agreement with the Administration;
  • violate the intellectual property rights of others;
  • create multiple accounts to circumvent restrictions or abuse the website's services;
  • use reverse engineering methods to analyze the website's software code;
  • take actions that impose an unreasonable or disproportionately large load on the website's infrastructure;
  • circumvent or attempt to circumvent any technological protection measures of the website;
  • use any devices, programs, or procedures to interfere with the normal operation of the website;
  • provide access to paid content or services to other individuals;
  • use the website's content to create competing products or services.

7. Applicable Law and Dispute Resolution

7.1. These Terms are drafted in accordance with Canadian law. Any claims, disputes, or other issues related to the use of the website are governed by the laws of the province of Ontario.

7.2. All disputes must be resolved exclusively through arbitration in the province of Ontario, Canada, and cannot be referred to judicial bodies without prior arbitration proceedings.

7.3. The user agrees that all personal data is processed in accordance with the Canadian Personal Information Protection and Electronic Documents Act (PIPEDA).

7.4. These Terms do not provide for user participation in class actions against the Administration. All disputes or claims are considered exclusively on an individual basis. The user waives the right to participate in any class actions, group proceedings, or represent the interests of other users in disputes with the Administration.

7.5. If any provision of these Terms is found to be invalid or unenforceable, it does not affect the validity or enforceability of the remaining provisions.

7.6. Any notices or other communications required or permitted under these Terms must be in writing and sent to the email address provided on the website.

7.7. The Administration's failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

7.8. The statute of limitations for any claims arising from the use of the website is limited to one (1) year from the date the cause of action arises.

7.9. The user agrees to indemnify the Administration for any losses, from a violation of these Terms or any applicable laws.

7.10. The Administration has the right to assign or transfer its rights and obligations under these Terms to any third party without the user's consent.
