Canada promised a second risk assessment before deportation

For those coming from Gaza or the West Bank

Canada remains concerned about what is happening in the Middle East. Previously, the government offered open work permits to Israelis and Palestinians in Canada, and now authorities have agreed to review the immigration ministry's decisions on refugees from Gaza and the West Bank.

Those who received a final adverse decision from the Immigration and Refugee Board of Canada or the Federal Court between December 23, 2022 and December 22, 2023 can now apply for a pre-removal risk assessment (PRRA) before deportation. People who received a final risk assessment decision during this period may also be eligible to reapply.

Under normal circumstances, a pre-removal risk assessment would not be allowed for 12 months after a negative decision. However, given the current situation in Gaza and the West Bank, the Government of Canada has decided to accommodate refugee claimants.

The Canada Border Services Agency has undertaken to notify persons who are already subject to an enforceable removal order of this possibility. However, the refugees themselves will be responsible for making the application. No one can guarantee a positive outcome of the PRRA, but the Department of Immigration promises additional time and a fair hearing.

Ministry staff will continue to decide each case individually based on the information provided.
