Ontario strengthens protections for new home buyers

A new code of ethics is coming into force soon.

The Ontario government is strengthening protections for buyers and owners of new homes by introducing a new "Code of Ethics for Builders and Sellers of New Homes". The Code sets out a simplified process for guaranteeing and defending claims for defects in new homes. The changes come into force on 1 July 2021 and are designed to improve current quality standards in construction. The new code will require licensed builders and property sellers to act professionally, honestly and with integrity.

"Our number one goal is to protect homeowners from unscrupulous builders and housing providers," said Ross Romano, Secretary of State and Consumer Services. — We all win when we raise the bar for quality construction and help buyers and owners get what they paid for. Our government is proud that on July 1, we are reaching the next milestone along the way."

Improvements are also being made to the Ontario New Homebuyer Protection Program dispute resolution system Tarion, they include:

  • a simplified claims process that is easier for consumers;

  • increasing the transparency of service provision;

  • An opportunity for homeowners who challenge Tarion's assessment of their warranty claim to ask the company to participate in mediation.
